123 The Condition of this Recognizance is Such that if the aforesd John Strawbridge be of the good behaviour and abearance to all their Maties Liege people of this Province & more especially to Greegory Murmurenough & Elizabeth his Wife dureing this Courts pleasure he paying all the Charges he in expended the aforesd Recognizance to be void and of no effect otherwayes to be & remaine & be in full power force & vertue.
Bryan: Peart. Plt. Somerset County Ss Robert Tyra late of Somerset County blacksmith was attached to answer Robert Tyra Dft } unto Bryan Peart in an action of the Case &ca. ~ ~ ~ ~ ~ ~ And whereupon the Said Bryan by Robert:Pirrie his Attorney complaineth that Whereas the Said Robert the third day of October in the year of our Lord 1692. at Snow hill within the Jurisdiction of this Court was indebted unto the Said Bryan in the Sum of eight hundred pounds of tobacco being the ballance of a Certain amount for Sundry goods &ca. by the Sd Bryan to the Said Robert at that time & before Sold & delivered as by a Certain Writeing Signed by the propper hand of him the Said Robert & here in Court ready to be produced may appear, and the sd Robert to the Said Bryan in manner aforesd being indebted in Consideration thereof did faithfully promise that he the Said Robert, the Said Sum of 800 pounds of tob. unto the Said Bryan when he should be thereunto requested would well & truely Content & pay . Nevertheless the sd Robert his promise & assumption aforesd not regarding but minding & fraudulently intending him the Said Bryan in this behalf craftily & Subtily to deceive & defraud the Said 800 pounds of tob or any part thereof to the sd Bryan hath not paid although the said Robert to doe the Same by the said Bryan hath been often requested, but hath hitherto refused & doth still refuse to ye damage of the Said Bryan of 1600 pounds of tob, & thereon brings this Sute &ca. Jno Doe Pirrie pr Quer. Pleg. prec &ca Rich Roe }
Non est factum & puts himself on the Court. — — Worthington pr Quer And the plt Saith that it is his very Act & Deed & of this he putteth himself upon the Court also Pirrie – – 12: Reckoned with my Master Bryan:Peart this 3th. day of October then due to him upon Ballance of one accot Eight hundred pounds of tobacco. Witness Robert: RT Tyrah his marke. RC Robert Cuthbert his marke. The issue being joynd as aforesd, it appeared to this Court the debt declared for to be justly due and therefore this Court grants Order for ye Same with Cost of Sute alias Executio – – R. Cuthbert Evid.
John: Dyer Plt. Somerset County Ss. Wm Robinson late of Somerset County was attached to answer unto John Wm: Robinson Dft} Dyer of a Plea of Trespas on the Case. &ca ______ And whereupon the sd John by ~ ~ ~ ~ ~ ~ ~ Edward Jones his Attorney Complaineth that whereas the sd William ye 27th. day of ffebry In the year of our Lord 1692/3 at Pocomoke within the Jurisdiction of this Court by a Certaine Instrument or Bill of Sale under the hand & Seal of him the Said William & here in Court Produced, the date whereof is the day & year aforesd did bargain & Sell unto the Said John One Browne Mare with a Blazel in her face branded (thus) [ ] with A yellowish Sorrel Colt, which Said Mare & Colt the Said William bound him Self & his Heirs to warrant & defend
