Their Maties agt             The Said Tindall & Barker in their Propper Persons appearing these following

Charles Tindall &         Precepts or Writeings were produced .viz -

County to the Constable of Poquadenorton hundred Greeting — Whereas Complaint hath been made to me this day [by]

Ephraim Wlson Sheriff of the County aforesd that by vertue of three Precepts to him directed one at y^e Sute of m^r ffrancis

Jenckins one other at y^e Sute of m^r James Round & one other at y^e Sute of m^r Peter Dent for y^e attaching the body of Peter

Whaples of this County in the acctions in y^e sd precepts or Writts therein Specified may appear in prosecution of which he

the Said Compainn^t directed his Subsheriff One Martin Trontram to Execute the Said writts which accordingly he the

Said Trontram did performe, and the Said Peter Whaples did take into his Custody but afterwards One John Barker and

Charles Tindall with Several others to the Number of Seaven or eight in or about the latter end of the month of August

last past with force & Armes & at the house of the Said Peter Whaples in y^e County aforesd the Said Peter Whaples out

of his the Said Subsheriffs Custody did violently Rescue & take to the breach of their Maties Peace & Contrary to the

Laws & Statutes in that Case made & provided — These are therefore in their Maties Names to will & require as also

Strictly Charge & Comand you on Sight hereof to apprehend the persons of them the Said John: Barker & CharlesTindall

or any of them & them to Secure until y^w Shall bring them before me or Some other of their Maties Justices of y^e Peace

for y^e County aforesd to answer y^e Complaint & Contempt aforesd hereof y^w are not to fail as y^w will answer the answer the

Contrary at aforesd y^r utmost peril & also have y^w there this precept given under my hand and Seal this twentieth day

of September An^o Dom. 1694. //

Somerset County in Maryland                Know all Men by these p^rsents that wee Charles Tindall & John Barker Cordwinder

and Jonathan Towers Planter all of Somerset County & Province aforesd doe owe and Stand firmly Bound & indebted

unto their Maties King William & Queen Mary in the full & just Sum of fourty pounds Sterling money to the true paym^t

whereof wee bind us & either of us Joyntly & Severally for y^e whole & in the whole us & either of our Heirs Executors

and Adm^rs firmly by these p^rsents In Whittness whereof wee have hereunto Sett our hands & fixed our Seals this 24^th day

of September Annoq Domini 1694.

The Condicon of this above Written Obligation is Such that if y^e above bound Charles Tindall Shall make his p^rsonall

appearance at y^e next Court to be held for the County of Somerset upon the Second Tuesday of November next then and there

to answer what shall be objected agt him on their Maties behalf in Relation to a Rescue made of Peter Whaples out of the

hands of Martin Trontham Subsherriff of the County abovesd That then this Obligation to be void & of none effect or

otherwise to remain in full force Strength effect & vertue.                                     Charles: Tindall. ❂

abovesd in the Province of Maryland, doe own & acknowledge our Selves to owe and Stand justly indebted unto their Maties

King William & Queen Mary the full & just Sum of fourty pounds Sterling money the which payment well & truely to be

made wee bind our Selves and either of us Joyntly and Severally for y^e whole and in the whole, us and either of our heirs

Executors and Administrators firmly by these presents. As witness our hands and Seals this 24^th day of September 1694

The Condition of the above Obligation is Such that if the above John: Barker doe make his p^rsonall appearance at o^r next County

Court to be holden the Second Tuesday of November next their to make answer to what Shall be Objected agt him on their Maties
