sell any such liquors within one hundred yards of the county
court house, unless at the time of applying for license therefor
he shall file with clerk of the Circuit Court of the county an
application in writing, verified by affidavit, stating the exact
place at which said liquor was to be sold, the manner of
selling the same, as to whether it is to be done in connec-
tion with a hotel or otherwise, and bearing the endorse-
ment of the commissioners of said town and the County Com-
missioners of Charles County ; the aforegoing provisions of
this section not to apply, however, to any place where any
such liquor is now sold under such license as is provided by
law in said town. Any person who shall violate the provisions
of this section shall, on conviction, pay a fine of not less than
fifty nor more than two hundred dollars for each offense, and
upon failure to pay the same, together with the costs of prose-
cution, shall be committed to jail and confined therein until
such fine and costs are paid, or for the period of forty days,
whichever shall first occur.

116 E. Any person who shall sell spirituous or fermented
liquors or lager beer, or who shall keep or conduct the busi-
ness of a hotel, inn or boarding house, whether the same shall
be a building exclusively for that purpose or in a dwelling
house, shall .pay a license of twenty-five dollars per year, or a
proportionate amount for periods less than a year. All such
licenses shall be paid to the clerk or bailiff appointed in
accordance with the provisions of this Act, for municipal
purposes, and shall run in all cases from the time of the begin-
ning of said business to the first of May ensuing. The license
herein imposed shall be in addition to any other license that
may be imposed by the Public General Laws of this State or
the Public Local Laws relating to Charles county ; but it is
not the intent hereof that any person keeping an hotel and
selling any of the aforesaid liquors shall pay the license herein
provided for, for more than one of such kinds of business.
Any person who shall violate the provisions of this sec-
tion shall, upon conviction, pay a tine of not less than
fifty nor more than two hundred dollars for each offense,
and upon failure to pay the same, together with the costs of
prosecution, shall be committed to jail and confined therein
until such fine and costs are paid, or for the period of forty days,
whichever shall first occur. No prosecutions before justices
of the peace for violation of any of the sections of this Act
or the Article of which this Act is amendatory, or of any of
the ordinances passed in pursuance thereof, shall fail, or any of
the proceedings therein be invalid, because of any defect or
error in matter of form, and the same shall be amendable to
such extent as may be necessary for the purpose of carrying
