visions of this section by permitting any one of any species
of any of said animals of either gender or of any age to run
at large within the limits aforesaid, belonging to him or in his
custody or control, for himself or as trustee for others, or as

one dollar for each individual of any species of the animals
named so permitted to run at large, to be recovered before a
justice of the peace, with such process and form of proceed-
ings and for such appeal and prayer for jury trial and other
rights as now prevail in this county in cases of misdemeanors
not punishable by confinement in the penitentiary, subject
however, to the modification as to term of imprisonment pro-
vided in section 102 of the Act hereby amended ; no hogs shall
be raised or kept, penned or unpenned, for any purpose or be
slaughtered or brought alive into the limits of La Plata, except
in transit through said town, and for that purpose they shall
be caged or in such manner confined as not to be able to walk
or run over any portion of the streets or other portion of said
town. Any person violating this provision or permitting it to
be violated in the case of any hog owned by himself or in his
custody or control shall be fined one dollar, recoverable as

hereinbefore just above provided. If any animal or animals
of any kind hereinbefore named, of which the owner shall be
unknown or cannot be found, shall be found running at large
in said town, the bailiff shall forthwith seize and impound the
same, and shall give notice thereof by notice posted at court-
house door, and if the owner shall not, within three days there-
after, appear and pay said bailiff the amount of the fine herein-
before imposed and twenty-five cents extra for each day after
the day in which the said animal shall be taken and impounded,
the said bailiff shall sell the same at public sale, and after
deducting one-half of the amount due on same, including tine,
which he shall retain, shall account for the balance to said
commissioners. It shall be the duty of the bailiff, as far as
practicable and possible, to enforce this and other provisions
of this Act, as well as the ordinances enacted by the Town
Commissioners, as provided in section 98 of the Act hereby
amended, and any wilful neglect upon his part to enforce
either of them when coming to his notice shall be malfeasance
in office. This section shall take effect from and after the first
day of May, nineteen hundred and two.
