between the points authorized by this Act, and where the con-
sent of the owners of such ground or property can not be ob-
. tained, shall have and may exercise in its discretion the right
and power of condemnation, as provided in the Code of Public
General Laws, article 23, title "Corporations," sub-title "Rail-
road Companies," and to buy, lease, sell to or consolidate with
any other railroad or railway, and to connect or enter into
traffic agreement with any other railroad or railway.
SEC. 14. And be it enacted, That the president and directors
of said company may borrow from time to time for the cor-
porate purpose of said company such amounts of money as
they may deem proper, and provide for the payment of the
sum and interest thereon by the issue of bonds in such amounts
as the board of directors may deem necessary for the purpose
of said railway and its extension, and to secure the payment
of the same by a mortgage of all or any part of the property,
rights, franchises, tolls and revenues of said company. -
SEC. 15. And be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 436.
AN ACT for the payment of a sum of money to David N.
Henning, of Carroll county, State of Maryland, for prose-
cuting in the Circuit Court for Carroll county and in the
Court of Appeals of Maryland, on the part of the State of
Maryland, reported in vol. 84, page 67 of the Maryland Re-
ports.
Whereas David N. Henning assisted the State of Maryland
in prosecuting the State of Maryland against Daniel H. Lynn,
in the Circuit Court of Carroll county, and upon conviction
of said Lynn and an appeal by him to the Court of Appeals of
Maryland, the said David N. Henning, by authority of Harry
M. Clabaugh, then Attorney General, who was disqualified to
try the said case, prepared and argued said case in the Court
of Appeals of Maryland, which was decided in favor of the
said State of Maryland with costs, to be paid to the said State.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the Comptroller of the State of Maryland be and
he is hereby directed to draw his warrant upon the Treasurer
of the State of Maryland for the sum of one hundred dollars,
in favor of David N. Henning in compensation in full for his
services in the trials of the State of Maryland against said
Daniel H. Lynn.
