operation and business; and provided, further, that so much
of its railway as may be located upon or along any of the
public highways of Allegany county that the work of construc-
tion shall be done under the supervision of the Board of Road
Directors of said county; and provided, further, that so much
of its railways as may be located upon or along the highways
of Garrett county that the work of construction shall be done
under the supervision of the road supervisors having jurisdic-
tion over the roads of said county lying contiguous to said
railway company's line; and provided, further, that said road-
bed and crossings of said railway company whenever upon,
along or across any of the streets of Frostburg, or the public
roads and highways of Allegany and Garrett counties, shall
always be kept in good repair and condition under the direc-
tion and supervision of the municipal authorities of said town
of Frostburg, and the authorities having charge and control
of the public roads and highways lying contiguous to said rail-
way in the counties of Allegany and Garrett.

SEC. 11. And be it further enacted, That the said corpora-
tion hereby incorporated is hereby authorized to connect with
or consolidate with such road or roads as it may cross or con-
nect with upon such terms as may be agreed upon between
them, or such corporation may purchase, lease or sell to such
crossing or connecting road or roads, or the same may be
leased or acquired by it.

SEC. 12. And be it further enacted, That the president and
directors of said corporation, or a majority of them, shall have
power to make and adopt, offer and amend such by-laws,
rules and regulations for the direction and management of said
company as may be in their judgment from time to time neces-
sary for the purposes of the corporation; provided, they are not
inconsistent with the Constitution and laws of the State and
the provisions of this charter; and the president and directors
of said company, or a majority of them, shall have the power
to employ all such agents and servants as in their judgment
may be necessary for the construction, maintenance, repair and
preservation of the railway and other property of said com-
pany, and the running of cars and the transportation of pas-
seugers aud freight thereon, and for the transaction of the
business for which it is incorporated.

SEC. 13. And be it enacted, That the said company be and it
is hereby authorized in order to construct said railway on such
land or property of any individual or corporation, or on such
private right of way of an individual or corporation, as it may
deem necessary to occupy in order to construct said railway
