CHAP. 1835

convenient to the citizens, and to improve its appearance

Declared a street

Sec. 3. And be it enacted, That after the said alley shall
have been widened and straightened as aforesaid, it shall be
deemed and considered to all intents and purposes a public
street, and may receive from the Mayor and City Council a
new name as such, and be in all respects subject to the ope-
ration of the several acts of Assembly, and ordinances or
other regulations of the Corporation of the city of Baltimore,
concerning the streets of the said city

Damages

Sec 4 And be it enacted, That the Mayor and City
Council aforesaid shall provide for ascertaining the amount
of damages which shall be sustained by any person or per-
sons, by opening or widening of the said alley, and for as-
sessing such amount with the necessary expenses incident to
the ascertainment of damages and opening and widening
said street, or any part of such damage and expences which
they shall deem proper, on the property, and the owners
thereof binding on each side of said alley, as the same shall
be widened and extended that shall be benefitted by opening
or widening said alley, and said assessment when finally

made shall be a hen upon such property, and for collection
of the same, the said persons and property, and extent of
damage and benefit to be ascertained in such manner as the
Mayor and City Council aforesaid shall by ordinance direct,
and they shall also provide by ordinance for granting appeals
to Baltimore City Court, and securing a jury trial before said
court to the owner or owners of any property which shall be
removed, taken, used, damaged or destroyed by reason of
opening or widening said street, who may deem him or her-
self aggrieved or injured in the valuation thereof, and also to
every other person or corporation who may deem him or
herself aggrieved or injured by reason of the assessment on
them for the payment of damages consequent upon the
opening or widening said alley Provided, the person or per-
sons, or corporation who may desire any such appeal, shall
within a reasonable time, not less than thirty days after pub-
lic notice in all the daily newspapers of said city, of the
ascertainment and returns to the City Registers Office, of the
amount of damages and benefits, apply by petition to the

said court, for such appeal or jury that, and the said City
Court shall be and is hereby empowered to do all such acts
in relation to the trial and decision, of such appeals, as the
ordinances of the said Mayor and City Council, passed hi
pursuance of this act, shall direct.
