in and imposed upon the State Department of Health with
respect to all orders, rules and regulations passed or pro-
mulgated under the provisions of this Section; and the
provisions of said Section 241 (d) relating to appeals to the
Circuit Court of Baltimore City or the Circuit Court No. 2
of Baltimore City shall likewise be applicable to the orders,
rules and regulations passed under the provisions of this
Section.
241 (h). The provisions of this sub-title shall not apply
to sales of poisons made to registered practitioners of
medicine, dentistry, pharmacy, or veterinary medicine, or
to sales made by any manufacturer, wholesale dealer or
licensed pharmacist to another manufacturer, wholesale
dealer, licensed pharmacist or the holder of a special per-
mit issued under the provisions of this sub-title of such
articles as he is authorized by his permit to sell, or to a
manufacturer of proprietary medicine, or to a hospital,
college, school, or scientific or public institution, or to the
sale of such poisons as are used in the arts, agriculture,
industry, or in manufacturing, to persons known to be
engaged in such pursuits and believed to be making the
purchase for legitimate use; provided, however, that in
all such cases the poisons are labeled in accordance with
the provisions of Section 241 (b) of this sub-title.
241 (i). Any person, co-partnership, association or
corporation violating any of the provisions of this sub-
title or any of the rules or regulations passed by the Mary-
land Board of Pharmacy or the Maryland State Depart-
ment of Health pursuant to the provisions of this sub-title,
shall, upon conviction, be deemed guilty of a misdemeanor
and fined not more than one hundred ($100) dollars for
each offense.

SEC. 3. And be it further enacted, That, if any of the
provisions of this Act, or the application thereof to any
person or circumstances, is held invalid, the remainder of
the Act, and the application of such provision to other
persons or circumstances, shall not be affected thereby.
