. down to said landing, in such manner as they, or a majority of
them may think most conducive to the public benefit; and the said
commissioners or a majority of them, are hereby required to re-
turn a plot of said landing place and road to the clerk of Somerset
county, there to be recorded, together with an estimate of the da-
mages sustained by any person or persons whose land may be ta-
ken, laid out and appropriated as aforesaid.

Levy.
|
2. And be it enacted, That if the said commissioners, or a
majority of them, shall be of opinion that the public convenience
does require that a landing should be established at or near the
aforementioned place, and a road located and opened as aforesaid,
they shall report the same in writing to the levy court of Somerset
county; and if the levy court or a majority of them shall approve
of such opinion, the said court is hereby empowered and directed
to assess and levy the amount of such damages as shall be ascer-
tained by the commissioners aforesaid; which sum of money shall
be levied, collected and paid over, as other county charges are
levied collected and paid over.

Compensation.
|
, 3. And be it enacted, That if the commissioners aforesaid
or a majority of them, shall be of opinion that the public conve-
nience does not require that a landing place should be established
at the aforementioned place, and a road located and opened, they
shall report such opinion in writing to the levy court aforesaid; and
each of the commissioners hereby appointed, shall have an allow-
ance of two dollars for each and every day's attendance in discharge
of the duties herein required, to be levied, collected and paid over
as other county charges are levied, collected and paid over.

grieved.
|
4. And be it Enacted, That if any person through whose
land said road may pass, or whose land may be condemned for the
landing aforesaid, shall conceive themselves aggrieved either by
the assessment of damages or by the location and condemnation as
aforesaid, it shall and may be lawful for such person or persons to
pray an appeal from the decision of said commissioners or the said
levy court, to the judges of Somerset county court, who are hereby
authorised and empowered to empannel a jury, and by a feigned
issue or issues, to be framed for that purpose, try any fact or facts
that may be thus put in issue, and filially to decide on such appeal
as to them shall seem just and equitable.

Preamble.

CHAPTER 44.
A supplement to an act entitled, "An act for the distribution of a cer-
tain fund for the purpose of establishing free schools in the several
counties therein mentioned."
Whereas, By an act entitled, An act to incorporate a company
to make a turnpike road leading to Cumberland, and for the exten-
sion of the charters of the several banks in the city of Baltimore,
and for other purposes, and its supplements, a fund has been
pledged for the establishment of free schools throughout the state;
And whereas, The said act and its several supplements, have direct-
ed that the said fund shall be equally divided among the several
counties of this state,

That the Orphans' Court of Cecil County, be, and they art hereby
