John Swaine late of Somerset County was attached to answer unto Hannah Maynard Admrx of all & Singular the goods Chattels & Credits of James Maynard decd of a plea of trespass of the Case &ca. — And whereupon the sd Hannah by Peter Dent her Attorney Complains that whereas the sd John the 23d day of March in the year of our Lord 1693 at Monocan within the Jurisdiction of this Court was indebted to the Said James in his lifetime in the Sum of twelve hundred & thirty foot of plank, two hundred & fifteen pounds of Porke & One hundred & thirteen pounds of tobacco being for sundries Sold & delivered as by account here in Court produced may appear & ye Said John to the sd James in his life time in manner afsd being indebted did assume on himselfe & to the said James faithfully promise that he the sd John the Same to the sd James when requested would well & truely Content & pay. Neverthelesse the sd John his promise & assumption aforesd not regarding but minding & fraudulently intending the sd James in this behalfe to deceive & defraud the Sums afd to the said James in his lifetime, nor to the sd Hanah Since the death of the sd James whome Admrn of all & Singular the goods Chattels & Credits, which were of the sd James above Comitted, or to either of them hath not paid but the same to pay hath refused to the damage of the sd Hannah of 3000 pounds of Tobacco & thereof she brings her Sute &ca.
