~ ~ ~ ~ ~ ~           answer to Joy Hobbs Adm^r of the goods

of Thomas Hobbs late of this County deceased of an accon of the Case &ca.

And whereupon the sd Joy Hobbs p^r Sam Worthington his Attorney

Complains that whereas the sd Richard on the fourth day of october

in the year of our Lord 1689 at Wiccocomocoe within y^e Jurisdiction

of this Court, came indebted unto the afd Thomas Hobbs in y^e

Just Sum of Seven hundred & twenty pounds of tobacco for Taylors

worke done by the sd Thomas for the Said Richard as p^r a p^rticuler acco^t

here in Court produced doth appear. And the sd Richard being indebted

in manner afd, did upon Self assume & faithfully promise that y^e

Said Sum of tobacco he would well & truely Content & pay to him y^e

Said Thomas Nevertheless the sd Richard the same hath not paid to y^e

Said Thomas in his lifetime nor to the sd Joy Since the decease of

the sd Thomas whereby the sd Joy Saith that he is damnified to the

Value of fourteen hundred & fourty pounds of tobacco & thereupon he

brings this Sute &ca. Worthington p^r Que^r pleges &ca.         Jn^o Doe

And the Dfend^t Saith they ought to have Sued by a Quanto Moriott

& not for a Special Sum as in the declaracon is declared & of this he

putts himselfe upon the Court Dent

And the plt Sayes that the acco^t Charged the dft with is a reasonable

& ought to be alowed being a book acco^t charged by y^e deceased Hobbs

& putts himself on the Court Worthington p^r plt.
