answer unto Robert Pirrie of an accon of the Case &ca. – –

And whereupon the Sd Robert Pirrie Complaineth that whereas y^e

Sd Doctor John in the month of March in the year of our Lord 1693/4

& June 1694 &ca at Manokin within the Jurisdiction of this Court

was indebted unto the Said Robert in the Sum or quantity of one thousand

pounds of good Sound Merchantable tobacco as p^r acco^t here in Court

produced may appear and the sd John to the sd Rob^t in manner afsd

being indebted in Consideration thereof did assume upon him Self and

& to the Said Rob^t faithfully promise that he the sd John the sd Sum

of 1000 pounds of tobacco when he should be thereunto requested would

well & truely Content & pay Nevertheless the sd John the sd 1000 pounds

of tobacco as afd to the sd Rob^t hath not paid although the sd John to

doe the Same hath been requested but hath hitherto refused & doth

Still refuse to the damage of the sd Rob^t. of 2000 pounds of tobacco

& thereupon he bring this Sute &ca.              Jn^o Doe

The Declⁿ & acco^t produced & proved, the Writt returned

Non Est Inventus the plt humbly Craved attachm^t agt y^e plts goods

&ca which was granted y^e plt giving Security according to Law //

Whereupon Came the sd Pirrie & his Securities Sam^ll Worthington &

Thomas Gillett & p^r Recognizance bound them Selves in the Sum of

2000 lbs of tobacco to the sd Vigerous as the Law in Such Cases requires

Memorandum that this day m^r ffra Jenckins with his Security

Cap^t John King, entered into Recognizance of 14000 pounds of tob

to make good his accon agt D^r Jn^o. Vigerous on a judgm^t obtained

by the sd Jenckins agt the sd Vigerous for 7394½ tob y^e 13^th

day of June an^o Dom 1695 as the law requires in Such Cases &ca.
