BE IT FURTHER RESOLVED by the Mayor and Council of the City
of Gaithersburg that the property described above and persons residing
therein, if any, shall after the effective date of this resolution be subject
to all of the laws, ordinances and resolutions of the City of Gaithersburg,
Maryland.

This is to certify that the foregoing resolution was introduced by the
City Council on the 2nd day of November, 1970, and adopted by the City
Council in public meeting assembled on the 21st day of December, 1970.

Ordinance No. 0-9-71

Proposing amendment of the City Charter requiring public hearing
and recommendation by Planning Commission in annexation cases.

BE IT ORDAINED, by the Mayor and Council of Gaithersburg, in pub-
lic meeting assembled that Section 21 of the Charter of the City of Gaith-
ersburg be and it hereby is amended by adding thereto a new paragraph
to be lettered h-1., to follow immediately after paragraph h, and to read
as follows:

"h-1. The Commission shall make a recommendation to the Council
with reference to every proposed annexation of new area into the City.
To that end the City Manager shall hereafter, promptly after the introduc-
tion by the Council of a petition for annexation deliver a copy thereof to
each member of the Commission with notice of the time, place and date of
the Council's hearing thereon. The Commission shall hold a public hearing
with reference to each such proposed annexation upon such notice as it
shall deem proper. Failure of the Council to receive a recommendation from
the Commission pursuant hereto shall not invalidate whatever action the
Council may take with reference to a proposed annexation."

I Hereby Certify that the foregoing Ordinance proposing amendment
to the City Charter was introduced by a vote of a majority of the Council
on November 1, 1971.
