place of beginning, said area to be represented by two commissioners residing
therein.
(D) Third District: The Third District shall comprise all that area beginning at a
point in the centerline of the B. & O. Railroad where the Eastern Town Boundary
crosses same, thence in a Northerly direction along said Eastern boundary to the
Northernmost Town Boundary thence in a Westerly direction by and with the
Northern Town Boundary to a point where same intersects the Eastern bank of the
Susquehanna River, thence in a Southerly direction along said Eastern bank of the
Susquehanna River to the beginning point of the First District, said point being the
centerline of the B. & O. Railroad, thence in an Easterly direction along the
centerline of the B. & O. Railroad to the point of beginning, said area to be
represented by two commissioners residing in the area.
(E) In the event no person shall file for commissioner to represent a certain
district or should the number of candidates from any one district be less than that
required to be elected for said district, then in that event, any person desiring to be
elected as a commissioner, regardless of which district they reside may file for such
vacancy to represent that district within ten days after the closing date for
nominations.
Section 2. And be it further resolved by the Commissioners of Perryville, Town
of Perryville, that Subsection (a) of Section 29-5 of the Code of Public Local Laws
of Cecil County, 1970, as amended, said section being a part of the Charter of the
Town of Perryville, be, and the same is hereby repealed and re-enacted with
amendments to read as follows:
Section 29-5. Eligible voters; board of election supervisors; election procedures
generally.
(a) Voters. Every person who (a) is a citizen of the United States, (b) is at least
[twenty-one] EIGHTEEN years of age, (c) has resided in the Town of Perryville
for at least one [year] MONTH next preceding any town election and (d) is
registered in accordance with the provisions of this charter, shall be a qualified
voter of the town. Every qualified voter of the town shall be entitled to vote at any
or all town elections.
Section 3. And be it further resolved that the date of adoption of this resolution
is July 11, 1972, and the re-enactment and amendments to the Charter of the
Commissioners of Perryville, Town of Perryville, hereby enacted shall become
effective on August 30, 1972, unless on or before August 20, 1972 there shall be
filed with the Board of Commissioners a proper petition for referendum as
permitted by law.
Section 4. And be it further resolved that the President of the Board of
Commissioners of Perryville be, and he is hereby directed to post a complete and
exact copy of this resolution at the Town Hall or other main municipal building or
public place for a period of at least forty days following its enactment and to cause
a fair summary of the proposed amendments to be published in a newspaper of
general circulation in the town not less than four times, at weekly intervals, within
forty days after enactment of this resolution.
Section 5. And be it further resolved that as soon as the charter amendments
hereby proposed shall become effective either as herein provided or following a
referendum, the President of the Board of Commissioners shall send separately by
registered mail to the Secretary of State of Maryland and to the Department of
Legislative Reference, the following information concerning the charter
amendments.
