2394 MUNICIPAL CHARTERS
N B THIS RESOLUTION IS SUBJECT TO A REFERENDUM AND SHALL
NOT BECOME EFFECTIVE UNTIL FORTY-FIVE (45) DAYS FOLLOWING
ITS ENACTMENT.
WHEREAS, not less than twenty-five (25%) percent of the owners of the
assessed valuation of the real property described below have petitioned The
Commissioners of Poolesville to annex, said property, and.
WHEREAS, said parcel of land is contiguous to the existing municipal
boundaries of the Town of Poolesville, and,
WHEREAS, the petition for annexation was duly advertised in accordance with
Article 23A Section 19 of the Annotated Code of Maryland (1957 Ed.), and.
WHEREAS, twenty-five (25%) percent of the persons who reside in the area to
be annexed have petitioned The Commissioners of Poolesville to annex the
property described below, and,
WHEREAS, the Planning Board for The Commissioners of Poolesville
recommended the approval of the said petition for reasons stated in an opinion
addressed to The Commissioners of Poolesville which is on file with the Town
Clerk,
NOW, THEREFORE, BE IT RESOLVED by The Commissioners of
Poolesville that the Resolution proposing a change of boundaries as requested by
the Petition be approved, and, further
BE IT RESOLVED that the existing boundaries of the municipal corporation
known as "The Commissioners of Poolesville", being the Town of Poolesville,
Maryland, be, and they are hereby extended to include an area as follows:
BEGINNING FOR THE SAME AT THE BEGINNING stone of Pooles
Hazard and running thence North 60 1/2 degrees East 53 perches to a stone; thence
North 27 3/4 degrees East 134 1/2 perches to a stone; thence North 74 degrees
East 78 perches to a stone, the beginning of a tract called Flints Grove, then with the
given line of said tract reversed with 2 degrees allowance for West variation South 25
1/2 degrees West 336 1/4 perches to a stone; then South 29 1/4 degrees West 46 1/
10 perches to a stone; thence North 50 3/4 degrees West 36 3/4 perches to a stone;
then North 14 1/2 degrees East 17 7/20 perches to a stone; then North 76 1/2
degrees West 46 2/5 perches to a stone; then North 8 1/4 degrees West 63 1/2
perches, and North 52 1/4 degrees East 94 9/10 perches to the beginning stone.
Containing 158 acres of land, more or less.
Said area and the persons residing therein to be subject to all the laws,
ordinances, regulations and charter provisions of The Commissioners of
Poolesville, but no municipal services and no municipal facilities shall be available
in said area unless and until installation and/or construction of such facilities are
constructed or installed and paid for by the residents therein and/or the owners
thereof, or the heirs, successors or assigns of either or both, provided that the then
existing facilities of THE COMMISSIONERS OF POOLESVILLE are adequate
for their extension to said area and persons.
