2402                                    MUNICIPAL CHARTERS

NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND
COUNCIL OF ROCKVILLE, MARYLAND,

That the following Resolution adding a new section to the Charter of the City
of Rockville, said new section to be known as Section 82, Article I (to follow
immediately after Section 81, Article I thereof) and as Section 49-91zz,
Montgomery County Code, 1960, (to follow immediately after Section 49-91yy
thereof) to provide for the enlarging of the corporate boundaries of the City of
Rockville, be and the same is hereby adopted to become effective on the 12th day
of August 1972.

SECTION 1. Be it enacted by the Mayor and Council of Rockville, Maryland
that the boundaries of the City of Rockville are hereby extended to include the
following area, which is hereby added to the said City:

All of a certain piece of ground known as part of "BURGUNDY" and etc.
surveyed by R.K. Maddox, February, 1972.

Beginning at an iron pipe set, adjacent to the intersection of North Homers
Lane and Southlawn Lane; thence in a northerly direction along the south side of
Southlawn Lane, (51 °42' E) a distance of three hundred thirty and thirty four
hundredths (330.34) feet to a PK nail set in macadam road (Southlawn Lane);
thence in a southerly direction (S 01 °16' 21" E) a distance of three hundred thirty
(330.00) feet to an iron pipe set; thence in a westerly direction (N 64 °50" 41" W) a
distance of two hundred ninety four and fifty hundredths (294.50) feet to an iron
pipe set near the intersection of North Homers Lane and Southlawn Lane at the
place of beginning. Total area 43,514 square feet.

Also described as:

All that tract of land which was conveyed to Rubin Hill and wife, to Henry A.
Williams, by deed dated May 2, 1902, and being part of a tract of land called
"Burgundy" and more particularly described as follows:

Beginning at the end of 139.4 perches on the last line of a conveyance from
Mary D. Lee to James L. Shaw; thence parallel with the first line of said
conveyance N 56 °E 20 perches; thence S 3 °W 19.94 perches to the last line of said
conveyance thence with said line, 1 1/4 "allowance for variation, N 60.50 °W 17.76
perches to the beginning, containing one acre of land more or less and being the
same land and premises which were conveyed by F. Barnard Welsh, attorney to
Margaret A.C. Welsh by deed dated July 31, 1939, which is recorded in Liber 743
at Folio 282, one of the Land Records of Montgomery County, Maryland. It is the
intention to convey all of the land obtained by the grantor in a deed recorded in
Liber 1120, Folio 357.

SECTION II. That all the territory hereby annexed to the City of Rockville
and the persons residing thereon, shall, after the effective date of this resolution be
subject to all the laws, ordinances and regulations of said City.

I hereby certify that the foregoing is
a true and correct copy of a Resolution
approved by the Mayor and Council at its
meeting of June 28, 1972.
