Resolution No. 34-72
CHARTER AMENDMENT NO. 28

RESOLUTION of the Mayor and Council of Rockville adopted pursuant to
the authority of Article XI-E of the Constitution of Maryland, Section 13 of
Article 23A of the Annotated Code of Maryland (1966 Replacement Volume), title
"Corporations - Municipal" subtitle "Home Rule", and Sections 48-15A to
48-15C, inclusive, of the Charter of the Mayor and Council of Rockville, as
amended, to amend the Charter of the Mayor and Council of Rockville, as set
forth in Sections 48-1 to 48-95, inclusive, of the Code of Public Local Laws of
Montgomery County (1965 Edition, as amended, being Article 16 of the Code of
Public Local Laws of Maryland) to repeal Section 48-5 thereof and to enact in its
place, with amendments, a new Section 48-5 so as to eliminate the six months
durational residence requirement as a condition of the right to vote in city
elections.

SECTION 1. BE IT RESOLVED by the Mayor and Council of Rockville that
the Charter of said municipal corporation as set forth in Sections 48-1 to 48-95,
inclusive, of the Code of Public Local Laws of Montgomery County (1965 Edition,
as amended, being Article 16 of the Code of Public Local Laws of Maryland), be
and the same is hereby amended by deleting Section 48-5 thereof and substituting
therefor a new Section 48-5, with amendments, to read as follows:

"Section 48-5. Voters

Every citizen of Rockville RESIDING THEREIN [who has resided within the
corporate limits of the said city for six months preceding any city general election
or who has resided for a like period of six months within an area annexed to said
city within a period of six months preceding any city general election,] and who is
qualified to register as a voter at the next succeeding state or congressional
election, or who may reach the age of eighteen years between the Second Tuesday
of November and the last Monday of April preceding any City general election,
and who is registered in accordance with the provisions of this Charter, shall be a
qualified voter of the city. Every qualified voter of the city shall be entitled to vote
at any or all city elections.

SECTION 2. BE IT FURTHER RESOLVED that the date of the adoption of
this Resolution is June 28, 1972 and that the amendment to the Charter of The
Mayor and Council of Rockville hereby proposed by this enactment shall be and
become effective on August 18, 1972 unless a proper petition for a referendum
hereon shall be filed as permitted by law. A complete and exact copy of this
Resolution shall be posted in the City Hall until August 8, 1972 and a copy of the
Title of this Resolution shall be published in a newspaper of general circulation in
the City of Rockville not less than four (4) times, at weekly intervals, before
August 8, 1972.

SECTION 3. AND BE IT FURTHER RESOLVED that as soon as the
charter amendment hereby enacted shall become effective, either as herein provided
