2404                                    MUNICIPAL CHARTERS

or following a referendum, the Mayor of the Mayor and Council of Rockville shall
send separately, by registered mail, to the Secretary of State of Maryland, and to
the Department of Legislative Reference, the following information concerning the
charter amendment: (1) the complete text of new Section 48-5 of the Charter of
the Mayor and Council of Rockville, as hereby enacted; (2) the date of the
referendum election, if any, held with respect thereto; (3) the number of votes cast
for and against the question containing the charter amendment, whether by the
Council of the Mayor and Council of Rockville or in a referendum; and (4) the
effective date of the charter amendment.

SECTION 4. AND BE IT FURTHER RESOLVED that the Mayor of the
Mayor and Council of Rockville be and he is hereby specifically enjoined and
instructed to carry out the provisions of Sections 2 and 3. As evidence of
compliance herewith, the said Mayor shall cause to be affixed to the minutes of
this meeting (1) appropriate certificate of publication of the newspaper in which
the Title of this Resolution shall have been published and (2) the return receipts of
the mailing referred to in Section 3, and shall further complete and execute the
Certificate of Effect attached hereto.

I HEREBY CERTIFY that the aforegoing is a true and correct copy of a
resolution adopted by the Mayor and Council of Rockville at its meeting of
June 28, 1972.

Resolution No. 39-72
CHARTER AMENDMENT NO. 29

RESOLUTION of the Mayor and Council of Rockville adopted pursuant to
the authority of Article XI-E of the Constitution of Maryland, Section 13 of
Article 23A of the Annotated Code of Maryland (1966 Replacement Volume), title
"Corporations - Municipal", subtitle "Home Rule" and Section 48-29 of the
Charter of the Mayor and Council of Rockville, as amended, to amend the
Charter of the Mayor and Council of Rockville, as set forth in Sections 48-1 to
48-95, inclusive, of the Montgomery County Code (1965 Edition, as amended,
being Article 16 of the Code of Public Local Laws of Maryland) to repeal and
re-enact, with amendments, Section 48-29 thereof, to delete part of Section 48-29
(f) providing that bonds may be issued by private negotiation if the terms of said
negotiation are more favorable to the city than terms obtained by competitive bid;
and to provide in its place that the mayor and council in its discretion may sell any
bonds, whose issuance is authorized by this section, by private negotiation,
