2408 MUNICIPAL CHARTERS
[(g)] (H) Annually the Director of Finance, or any of his assistants, shall
cremate or burn all of said bonds and coupons which have been redeemed and paid
by the Mayor and Council of Rockville and returned to the said Director of
Finance up to the close of the last preceding fiscal year. Appropriate cremation
certificates, attested to by the Clerk-Treasurer and the Director of Finance,
showing the amount of bonds and coupons so destroyed, shall be entered upon the
records of the Director of Finance and copies shall be filed with the
Clerk-Treasurer.
[(h)] (I) Nothing contained in this Section shall be deemed or construed to
impair the terms and conditions of any bonds or other obligations of the City of
Rockville issued prior to the effective date of this Section.
[(i)] (J) The authority conferred by this Section shall be in addition to other
applicable authority, including the provisions of public general laws of the State of
Maryland and the Mayor and Council of Rockville shall be entitled to exercise all
of the powers therein contained, notwithstanding the provisions of this Section.
SECTION 2. BE IT FURTHER RESOLVED that the date of the adoption of
this Resolution is July 31, 1972, and that the amendment to the Charter of The
Mayor and Council of Rockville hereby proposed by this enactment shall be and
become effective on September 19, 1972, unless a proper petition for a referendum
hereon shall be filed as permitted by law. A complete and exact copy of this
Resolution shall be posted in the City Hall until September 9, 1972, and a copy of
the Title of this Resolution shall be published in a newspaper of general circulation
in the City of Rockville not less than four (4) times at weekly intervals, before
September 9, 1972.
SECTION 3. BE IT FURTHER RESOLVED that as soon as the charter
amendment hereby enacted shall become effective, either as herein provided or
following a referendum, the Mayor of the Mayor and Council of Rockville shall
send separately, by registered mail, to the Secretary of State of Maryland, and to
the Department of Legislative Reference, the following information concerning the
charter amendment: (1) the complete text of Section 48-29 of the Charter of the
Mayor and Council of Rockville, as hereby enacted; (2) the date of the referendum
election, if any, held with respect thereto; (3) the number of votes cast for and
against the question containing the charter amendment, whether by the Council of
the Mayor and Council of Rockville or in a referendum; and (4) the effective date
of the charter amendment.
SECTION 4. AND BE IT FURTHER RESOLVED that the Mayor of the
Mayor and Council of Rockville be and he is hereby specifically enjoined and
instructed to carry out the provisions of Sections 2 and 3. As evidence of
compliance herewith, the said Mayor shall cause to be affixed to the minutes of
this meeting (1) appropriate certificates of publication of the newspaper in which
the Title of this resolution shall have been published and (2) the return receipts of
the mailing referred to in Section 3 and shall further complete and execute the
Certificate of Effect attached hereto.
SECTION 5. AND BE IT FURTHER RESOLVED THAT IF ANY PART
OR PARTS OF THIS SECTION OF THE CHARTER SHALL BE HELD TO
BE ILLEGAL OR UNCONSTITUTIONAL, THE ILLEGALITY OR
UNCONSTITUTIONALITY SHALL NOT AFFECT THE VALIDITY OF
THE REMAINING PARTS OF THIS SECTION. THE MAYOR AND
