Annotated Code of Maryland

(1971 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Sections 367A through 367C, inclusive,
to be under the new subtitle "Cremation" be and they are
hereby added to Article 43 — Health, of the Annotated
Code of Maryland (1971 Replacement Volume and 1975
Supplement) to read as follows:

Article 43 - Health

CREMATION

367A.

A FUNERAL DIRECTOR MUST KEEP ON RECORD AN
AUTHORIZATION IN A FORM PRESCRIBED BY THE BOARD FOR EVERY
CREMATION IN WHICH HE IS INVOLVED.

367B.

(A)    A [[BODY]] DECEASED HUMAN MAY NOT BE CREMATED
UNTIL AT LEAST 12 HOURS AFTER DEATH.

(B)    A DECEASED HUMAN BODY MAY NOT BE CREMATED
UNTIL IT HAS BEEN IDENTIFIED BY EITHER THE NEXT OF KIN,
THE PERSON [[MAKING]] AUTHORIZED TO MAKE THE FUNERAL
ARRANGEMENTS OR THE MEDICAL EXAMINER. THIS SUBSECTION
DOES NOT APPLY TO DISPOSITION OF BODIES BY ANY SCHOOL OF
ANATOMY, MEDICINE OR DENTISTRY.

(C) A DECEASED HUMAN BODY MAY NOT BE TRANSPORTED

TO A CREMATORY WITHOUT USING A COT AND POUCH OR

RECEPTACLE FOR THE BODY.

367C.

ANY PERSON WHO VIOLATES ANY PROVISION OF THIS
SUBTITLE IS GUILTY OF A MISDEMEANOR AND SUBJECT TO A FINE
NOT EXCEEDING $1,000.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
