[[Sheriffs and Deputy Sheriffs]] Law Enforcement
Officers and Sheriffs — Death Benefits

FOR the purpose of providing a benefit to the survivors
of sheriffs and deputy sheriffs killed in the
performance of their duties; providing that the

benefit to Sheriffs, deputies, and to law

enforcement officers shall be less the present
value of a certain benefit provided by the State
Retirement System; and clarifying the language.

BY repealing and reenacting, with amendments,

Article 41 - Governor—Executive and

Administrative Departments
Section 59A-1 (a)
Annotated Code of Maryland
(1971 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 59A-1 (a) of Article 41 -
Governor-Executive and Administrative Departments, of the
Annotated Code of Maryland (1971 Replacement Volume and
1975 Supplement) be and it is hereby repealed and
reenacted, with amendments, to read as follows:

Article 41 — Governor—Executive and
Administrative Departments

59A-1.

(a) [[The sum of $25,000 less any lump sum death
benefit, exclusive of any return of contributions OR LESS
THE PRESENT VALUE OF ANY BENEFIT PAYABLE UNDER THE
PROVISIONS OF ARTICLE 73B, SECTION 11(11)(B) OF THE
ANNOTATED CODE OF MARYLAND, payable by the State or any
political subdivision shall be paid to the surviving
spouse or children of any law—enforcement officer of the
State or of any political subdivision of the State,
INCLUDING ANY SHERIFF OR DEPUTY SHERIFF, who is killed in
the performance of his duties. This sum shall be in
addition to any workmen's compensation benefits.]] A

DEATH BENEFIT SHALL BE PAID TO THE SURVIVING SPOUSE OR

CHILDREN OF ANY LAW-ENFORCEMENT OFFICER OF THE STATE OR

OF ANY POLITICAL SUBDIVISION OF THE STATE, OR ANY SHERIFF

OR DEPUTY SHERIFF, WHO IS KILLED IN THE PERFORMANCE OF

DUTIES. THE AMOUNT OF THE BENEFIT SHALL BE $25,000, LESS:

(I) ANY LUMP SUM DEATH BENEFIT PAYABLE BY

THE STATE OR ANY POLITICAL SUBDIVISION, EXCLUSIVE OF ANY

RETURN OF CONTRIBUTIONS, OR,

(II) THE PRESENT VALUE OF ANY BENEFIT PAYABLE
UNDER THE PROVISIONS OF ARTICLE 73B, SECTION 11(11)B OF
THE CODE.
