AN ACT concerning

Forgery — Power of Attorney

FOR the purpose of including forgery of a power of
attorney within the forgery statute.

BY repealing and reenacting, with amendments,

Article 27 - Crimes and Punishments

Section 44

Annotated Code of Maryland

(1971 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 44 of Article 27 - Crimes and
Punishments, of the Annotated Code of Maryland (1971
Replacement Volume and 1975 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows:

Article 27 — Crimes and Punishments

44.

Any person who shall falsely make, forge or
counterfeit, or cause or procure to be falsely made,
forged or counterfeited, or willingly aid or assist in
falsely making, forging, altering or counterfeiting any
deed, document or affidavit of waiver or release of
mechanics' lien, will, testament or codicil, POWER OF
ATTORNEY, bond, writing obligatory, bill of exchange,
promissory note for the payment of money or property,
endorsement or assignment of any bond, writing
obligatory, bill of exchange, promissory note for the
payment of money or property, acquittance or receipt for
money or property, or any acquisition or receipt either
for money or for property, with intention to defraud any
person whomsoever, or shall utter or publish as true any
false, forged, altered or counterfeited deed, will,
testament or codicil, POWER OF ATTORNEY, bond, writing
obligatory, bill of exchange, promissory note for the
payment of money or property, or endorsement, or
assignment of any bond, writing obligatory, bill of
exchange, promissory note for the payment of money or
property, acquittance or receipt for money or property,
or shall utter or publish as true, with intention to
defraud any person whomsoever any false document of
waiver or release of mechanics lien shall be deemed a
felon, and on being convicted thereof shall be sentenced
to the penitentiary for not less than one nor more than
ten years.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
