LAWS OF MARYLAND

Ch. 21

(2) "HEALTH CARE FACILITY" DOES NOT INCLUDE A
HOSPITAL OR RELATED INSTITUTION. THAT IS OPERATED OR IS
LISTED AND CERTIFIED BY THE FIRST CHURCH OF CHRIST,
SCIENTIST, BOSTON, MASSACHUSETTS.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
41, § 59D(i) and the first sentence of (p).

In paragraph (l)(iii) of this subsection, the
reference to the "United States Department of
Health and Human Services" is substituted for the
reference to the "United States Department of
Health, Education and Welfare", to conform to
current terminology.

In paragraph (l)(iv)3. of this subsection, the
reference to "any office of ... dentists who are
organized as a professional association" is
substituted for the reference to "organized ...
for group practice", which apparently was
intended as a reference to a professional
association.

Paragraph (l)(v) of this subsection is revised to
incorporate the substance of the first sentence
of former Article 41, § 59D(p), which defined
"rehabilitation facility" for purposes of former
Article 41, §§ 59D(m) and 59J. The former
reference to Article 41, § 59D(m) was apparently
incorrect, since the term appeared in former
Article 41, § 59D(i).

The second sentence of former Article 41, §
59D(p), which defined "rehabilitation facility"
to include an outpatient facility for all
purposes other than former Article 41, §§ 59D(m)
and 59J, is deleted as unnecessary since the term
does not appear elsewhere in Part I of this
subtitle.

Defined terms: "Certificate of need" § 19-101
"Federal Act" § 19-101 "Physician" § 1-101
"Includes"/"including" § 1-101

(F) HEALTH SERVICE AREA.

"HEALTH SERVICE AREA" MEANS AN AREA OF THIS STATE THAT
THE GOVERNOR, WITH THE APPROVAL OF THE UNITED STATES
SECRETARY OF HEALTH AND HUMAN SERVICES, DESIGNATES UNDER
THE FEDERAL ACT AS APPROPRIATE FOR PLANNING AND DEVELOPING
OF HEALTH SERVICES.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
