systems agency" is substituted for "joint
comprehensive health planning agency", to conform
to the terminology elsewhere in Part I of this
subtitle. Therefore, former Article 43, §
874(1), which defined "Agency" to mean a joint
comprehensive health planning agency, is deleted
as unnecessary.
In subsection (a)(2) of this section, the
reference to the "United States Secretary of
Health and Human Services" is "substituted for the
reference to the "Secretary of Health, Education
and Welfare", to conform to current terminology.
Also in subsection (a)(2) of this section, the
former reference to consultation with the
Governor is deleted as unnecessary in light of §
19-109 of this subtitle and the Federal Act.
In subsection (b) of this section, the phrase
"member{s} of the governing" bodies is
substituted for "elected official{s}", to
incorporate the substance of former Article 43, §
874(3), which defined "{e}lected
representative" as a "member of the governing
body of a county". This substitution is based on
the apparent intent of defining "elected
representative", since that term did not appear
in former Article 43, §§ 871 through 877,
although defined for purposes of those sections.
In subsection (c)(3) of this section, the former
word "debts" is deleted as unnecessary in light
of the broad word "obligations".
In subsection (c)(4) of this section, the former
reference to "purchase or in any other manner,
and take, receive, own" is deleted as unnecessary
in light of the broad references to "acquire" and
"hold".
In subsection (c)(7) of this section, the former
limitation "not inconsistent with law ..." is
deleted as unnecessary.
Former Article 43, §§ 875(a) and 876(7), which
delineated the purposes and duties of the body
created under this section, are deleted as
misleading since the purposes and duties are not
unique to the health systems agencies created by
governing bodies under this section, but apply to
all health systems agencies. See 42 U.S.C. §
3001-2.
