19-111. COMMENTS OF HEALTH SYSTEMS AGENCIES.

AS SOON AS POSSIBLE, EACH HEALTH SYSTEMS AGENCY SHALL
SUBMIT TO THE SECRETARY COMMENTS ON THE PROGRAM AND
BUDGETARY PRIORITIES PROPOSED IN THE DEPARTMENT'S 5-YEAR
PLAN.

19-112. CERTIFICATE OF NEED REQUIRED.

(A)  "HEALTH CARE SERVICE" DEFINED.

IN THIS SECTION, "HEALTH CARE SERVICE" MEANS ANY
CLINICALLY RELATED PATIENT SERVICE.

(B)  IN GENERAL.

A PERSON SHALL HAVE A CERTIFICATE OF NEED ISSUED BY THE
STATE AGENCY BEFORE THE PERSON DEVELOPS, OPERATES, OR
PARTICIPATES IN ANY OF THE FOLLOWING HEALTH CARE PROJECTS
FOR WHICH A CERTIFICATE OF NEED IS REQUIRED UNDER THIS
SECTION.

(C)  NEW FACILITY.

A CERTIFICATE OF NEED IS REQUIRED BEFORE A NEW HEALTH
CARE FACILITY IS BUILT, DEVELOPED, OR ESTABLISHED.
