SUBTITLE 5. PROHIBITED ACTS; PENALTIES.
14-501. PRACTICING WITHOUT LICENSE.
EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE, A PERSON MAY NOT
PRACTICE, ATTEMPT TO PRACTICE, OR OFFER TO PRACTICE ENGINEERING
IN THE STATE UNLESS LICENSED BY THE BOARD.
REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 75 1/2, §
18(a)(1) and, as it related to the practice of
engineering, § 1(c).
The reference to "attempt" to practice is added to
conform to similar provisions governing other
regulated occupations in the Code. See, e.g., HO §
8-401, as to nursing home administrators, and HO §
15-505, as to podiatrists.
Former Art. 75 1/2, § 18(a)(6), which prohibited the
attempted use of an "expired or revoked or
nonexistent" license is deleted as unnecessary. The
former prohibition apparently was intended to serve 2
purposes: first, to prohibit the attempted practice of
engineering by use of an invalid license; and second,
to prohibit misrepresentations by use of an invalid
license. These specific prohibitions are fully
encompassed in the general prohibitions under this
section against practicing, attempting to practice,
and offering to practice, and the general prohibition
under § 14-502 of this subtitle against
misrepresentations.

14-502. MISREPRESENTATION.
UNLESS AUTHORIZED UNDER THIS TITLE TO PRACTICE ENGINEERING
WITHOUT THE SUPERVISION REQUIRED UNDER § 14-303 OF THIS TITLE, A
PERSON MAY NOT REPRESENT TO THE PUBLIC, BY USE OF A TITLE,
INCLUDING "ENGINEER", "PROFESSIONAL ENGINEER", "LICENSED
ENGINEER", OR "REGISTERED ENGINEER", BY USE OF THE TERM
"ENGINEERING" IN THE NAME OF THE PERSON'S BUSINESS ACTIVITY, BY
DESCRIPTION OF SERVICES, METHODS, OR PROCEDURES, OR OTHERWISE,
THAT THE PERSON IS AUTHORIZED TO PRACTICE ENGINEERING IN THIS
STATE.
