WILLIAM DONALD SCHAEFER, Governor

Ch. 3

Defined term: "Board" § 15-101
15-204. QUORUM; MEETINGS; COMPENSATION; STAFF.

(A)  QUORUM.

THREE MEMBERS OF THE BOARD ARE A QUORUM.

(B)  MEETINGS.

THE BOARD SHALL DETERMINE THE TIMES AND PLACES OF ITS
MEETINGS.

(C)  COMPENSATION AND REIMBURSEMENT FOR EXPENSES.
A MEMBER OF THE BOARD:

(1)  MAY NOT RECEIVE COMPENSATION; BUT

(2)  IS ENTITLED TO REIMBURSEMENT FOR EXPENSES UNDER
THE STANDARD STATE TRAVEL REGULATIONS, AS PROVIDED IN THE STATE
BUDGET.

(D)  STAFF.

THE BOARD MAY EMPLOY A STAFF IN ACCORDANCE WITH THE STATE
BUDGET.

REVISOR'S NOTE: Subsections (a) and (c) of this section are
new language derived without substantive change from
former Art. 56, § 332(a) and (c).

Subsections (b) and (d) of this section are standard
language added for clarity.

In subsection (c) of this section, the former
reference to "all actual traveling, incidental and
clerical" expenses "necessarily incurred in carrying
out ... this subtitle" is deleted as unnecessary in
light of the reference to the "Standard State Travel
Regulations". See SF § 10-203 and COMAR 23.02.01.01
through 12.

The Business Occupations Article Review Committee
notes, for consideration by the General Assembly, that
the addition of a second consumer member to the Board
in 1979 substantially changed the effect of the quorum
requirement in subsection (a) of this section. As
originally formed, the Board consisted of 5 members,
and the quorum requirement of 3 members constituted a
simple majority of the membership. Ch. 236, Acts of
1979, added a second consumer member to the Board.
