"REMEDIATION" MEANS TREATMENT FOR SPECIFIC AREAS OF MENTAL AND
SOCIAL DEFICIENCIES THAT ARE HIGHLY RELATED TO CRIMINAL BEHAVIOR

REVISOR'S NOTE: This subsection formerly was Art. 31B, § l(i).

The only changes are in style.

(I) VICTIM.

"VICTIM" MEANS:

(1) AN INDIVIDUAL WHO SUFFERS PERSONAL PHYSICAL INJURY OR
DEATH AS A DIRECT RESULT OF A CRIME; OR

(2) IF THE VICTIM IS DECEASED, A DESIGNATED FAMILY MEMBER OF
THE VICTIM.

REVISOR'S NOTE: This subsection formerly was Art. 31B, § 1(k).

In item (1) of this subsection, the reference to an "individual" is substituted
for the former reference to "person" because only a human being, and not
the other entities included in the defined term "person", can suffer
personal physical injury or death. See § 1-101 of this article for the
definition of "person".

No other changes are made.

SUBTITLE 2. GENERAL PROVISIONS.

4-201. ESTABLISHMENT.

THERE IS A PATUXENT INSTITUTION IN THE DEPARTMENT.

Art. 31B, § 2(a).

Defined term: "Department" § 1-101
4-202. PURPOSE.

(A) IN GENERAL.

THE PURPOSE OF THE INSTITUTION IS TO PROVIDE REMEDIATION PROGRAMS
AND SERVICES TO YOUTHFUL ELIGIBLE PERSONS, INCLUDING A RANGE OF
PROGRAM ALTERNATIVES INDICATED BY THE CURRENT STATE OF KNOWLEDGE TO
BE APPROPRIATE AND EFFECTIVE FOR THE POPULATION BEING SERVED.

(B) RESEARCH, DEVELOPMENT, AND TRAINING.

THE INSTITUTION SHALL ESTABLISH AND MAINTAIN, AS AN INTEGRAL PART OF
THE PROGRAMS, AN EFFECTIVE RESEARCH, DEVELOPMENT, AND TRAINING EFFORT
TO EVALUATE AND RECOMMEND IMPROVEMENTS ON AN ONGOING BASIS.
