to keep a fair Account of their Proceedings, therein inserting the
Goods or Estate sold, to whome, and at what rates, and such Com-
missrs are hereby directed and obliged to make sale of such Goods
and Estate by way of Auction to the highest Bidder. And such Sale
so by them to be made and done, whether of Lands or of Personal
Estate, shall be good and available in Law to all Intents and pur-
poses, as if the Person so absconded become Bankrupt stoping and
refusing payment as aforesaid had made the same before his or her
Bankruptcy stoping and refusing Payment as aforesaid and where
Sale shall be of Lands, the said Commissrs shall and may, and they
are hereby directed and empowered, to sign, Seal, execute and Ac-
knowledge a Deed or Deeds of Bargaine and Sale for such Lands so
by them to be sold, expressing therein the Consideration, and that
the same Deed is made in Virtue of this Act as Commissr, which
Deed or Deeds shall be Acknowledged and recorded as the Laws of
this Province directs, Deeds of Bargain and Sale to be; and the
Vendee or Vendees shall have and hold all the Right, Title, and
Estate which such Person or Persons so absconded, become Bank-
rupt, stoping and refusing payment as aforesaid, had or enjoyed, or
which of Right he, she, or they ought or might have, hold or enjoy in
such Lands of Tenements so sold and conveyed as aforesaid and
to the End that an Equal and lust Distribution may be made by such
Commissioners of the produce of the Estate of such Persons ab-
sconded, become Bankrupt stoping and refusing Payment in manner
aforesaid.
Be it Enacted That the said Commissioners shall after such sale
made and Compleated, and in Six Months at least after the date
of their Commission, appoint A Time and Place to make such Dis-
tribution, and notify the same by Setting up Advertisements in the
most Public Places within their County or Counties where the
Creditors mostly reside, that such Time and Place is appointed for
distributing the Produce of such Estate, And then and there, without
Fraud or Delay, make, or cause to be made, A fair and just Dividend
of the Produce of such Estate among the just and fair Creditors of
such person so absconded, become Bankrupt, stoping and refusing
payment in manner aforesaid, the Demand of such Creditors being
first duly proved allowed; and such Division make in proportion to

the Proved and allowed Demands of such Creditors, and the Amount
of the Value of the Estate of such Person so absconded, become
Bankrupt, stoping and refusing Payment in manner as aforesaid;
and a Fair Account keep of the Sums by the respective Creditors
demanded, and what to them paid; and in such Book take Discharge,
for the sums by them paid, from such Creditors, or their proper
Agents who shall receive the same which said Books shall be pro-
duced to the view of any Creditor desiring the same: And when
the sale and Payment of such Estate shall be compleated, the said
Books shall, by the respective Commissrs be returned into the Court
