deem necessary for conducting the affairs of said
company until the first Saturday of November
thereafter, and until a new election shall be held,
which said election shall take place annually on

President and
Managers.

the first Saturday of November, and the President
and Managers shall make such rules, regulations
and by-laws for the government of said Company
not inconsistent with, the laws of the State, and
each stockholder, in any election of officers, shall
have one vote for each share of stock by him, her
or them held ; provided that no person or body
politic shall have more than thirty votes.

Title.

Sec. 3. And be it enacted. That the stockholders
5n said Company shall be and they are hereby con-
stituted a body politic by the name of the "Hagers-
town and Cross Roads Turnpike Company/' and
by that name shall have succession during the
continuance of this corporation, may sue and be
sued, answer and be answered in any court of law
and equity in this State, and may do and execute
every other matter and thing by the name afore-
said that they are authorized to do in and by
virtue of this act.

Subscriptions
— additional.

Sec. 4. And be it enacted, That the President
and Managers after their election, as hereinbefore
provided for, shall have full power to receive addi-
tional subscriptions, and shall cause the said road
to be laid out on or near the bed of the county
road leading from Hagerstown to Cearfoss Cross
Roads, known as the Hagerstown and Mercersburg
Road, making an artificial bed of stone or gravel
not less than sixteen feet in width.

Time.

Sec. 5. And be it enacted, That the said Com-
pany shall cause said road to be completed within
five years from the organization thereof; other-
wise the right of said stockholders shall revert to
the State of Maryland.

Toll-gates.

Sec. 6. And be it enacted, That the President
and Managers aforesaid shall have the right to
erect a toll-gate or toll-gates, and to appoint a toll
gatherer or toll gatherers, whose duty it shall be
to receive of and from all and every person or per-
sons using said road the tolls and rates hereinafter
mentioned, and to stop any person riding, leading
or driving any horse, cattle, sheep, coach or any
