Councilmen of said town; and the said Judges of
Election, before opening the polls, shall take an
oath before some Justice of the Peace in said town
to permit every qualified person to vote, and none
other, and a majority of said three Judges shall
have power to do all things under this Section, in
case one of them dies or refuses to act; and the
Mayor and Councilman then elected shall imme-
diately qualify, and serve until the first Monday

in May, eighteen hundred and seventy-one, or
until their successors shall qualify; all future
Mayors and Councilmen elected according to the
preceding Sections shall qualify by the first Mon-
day in May, and take possession of their offices
the first Monday in May each year.

Sec. 6. And be it enacted, That the Mayor and
Gouncilmen of the town of Frostburg for each
succeeding election shall appoint three Judges of
Election, who shall have power to appoint clerks
and conduct the elections in all respects as the
elections for members of the General Assembly
are required to be conducted, opening the polls at
nine o'clock in the morning, and closing them at
six o'clock in the evening; and the said Judges
and clerks shall receive the same compensation as
Judges and clerks of election in Allegany County,
to be paid for by the said town.

Succeeding
election.

Sec. 7. And be it enacted, That in case of the
death, refusal to act, resignation, disqualification
of the Mayor or any of the Councilmen, the Coun-
cilmen or the remaining Councilmen, shall direct
an election to be held to fill such vacancy, and
the Mayor and Couneilmen, or remaining Coun-
cilmen, shall give at least ten days notice of all
elections by advertisement, in one or more news-
papers published in said town or county.

Sec. 8. And be it enacted, That the Mayor shall
ex-officio have all the powers of a Justice of the
Peace in cases where the town is a party, and an
appeal may be taken from his judgment to the
Circuit Court for Allegany County, in the same
manner as from a judgment of a Justice of the
Peace for said county.
