at Some Convenient Landing in Pocomoke River in Somerset County at or upon ye 10th day of October next ensueing the

date hereof To which payment the sd Wm.Henderson bound himself firmly by his said Bill Nevertheless the sd Wm

Henderson although often required the Same to the sd Hope the Said Sum of 400 Pounds of tobacco hath not rendered but

hitherto denyed and still doth deny & unjustly detein to the damage of the said Hope Taylor of 800 Pounds of Tobacco &

thereupon he brings his Sute &ca.                  Worthington pr Quer Pleg. &ca.     Jno. Doe Rich. Roe }

and the Defendt by Robert Pirrie his Attorney Saith that & well it is that ye Dft by the Plt did prsent his Bill for

four hundred pounds of tobacco upon Consideration that the plt to the dft & for his use Should receive Sixty Six yard of good

sufficient Cloth but So it is that the plt hath [Woven]only to the Deft thirty One yards & ½ yard of Cloth which amounts unto

One hundred eighty nine Pounds of tob for ye paymt of which tob the Defendt hath tendered pay & was always ready and

yett is. And of this he putts himself upon the Court Pirrie pr Dft. – – – – – – – – – – – –

                            vide Bill

This Bill bindeth me William Henderson of Somerset County in the Province of Maryland Planter me my Heirs Extors

or Assigns to pay or Cause to be paid unto Hope Taylor of the foresd County him his Heirs or Assigns the full & just

Sum of four hundred pounds of good sound Merchantable Tobacco & Caske to containe the Same to be paid at some Convenient

Landing in Pocomoke River at or upon the tenth day of October next ensueing the date hereof & for ye true performance of

the Same I bind myself my Heirs Extors unto Hope Taylor or his Lawfull Attorney, as wittness my hand & Seal this 8th day

Thomas Porter by Petion humbly Craved to be discharged from his Bonds of Behaviour which being Considered

by their Worpps Proclamacon was made & the sd Porter from his Said Bonds acquitted as prayed &ca.

     



Peirce Bray Plt Somerset County Ss. Thomas Dixon Admr of all & Singular the goods & Chattels of Robert

       Contra        } Dukes late of this County deceased was attached to answer unto Peirce Bray and Mary his

Thomas:Dixon Dft Wife Sole Extrx of all & Singular the goods & Chattels of Archibald White late of ye Same

~ ~ ~ ~ ~ ~ County deceased in an accon of ye Case. _____ And whereupon the Said Peirce and Mary by Sam.

Alexander their Attorney Saith that the Said Robert in his life time that is to Say on ye 10th. day of August in the year of or Lord

1691 Att Anamessex within the Jurisdiction of this Court was indebted unto the Said Archibald in the just & full Sum of

Six hundred pounds of good Sound Merchantable tobacco which he the Sd Robert did upon himself assume & to the sd Archibald

faithfully promise to Satisfie & pay Nevertheless the sd Robert in his life time, Nor the sd Thomas, Since the death of the

sd Robert. to the sd Archibald in his life time nor to the sd Mary in the time of her being Sole & unmarried nor to the said

Peirce & Mary Since their marriage had & Solemnized, the sd Sum of Six hundred pounds of tobacco hath not paid although

often thereunto required, but to doe the same hath refused, and doth Still refuse to the damage of ye sd Peirce & Mary of 1200 lbs

of tobacco & thereupon they bring this Sute
