( 129 ) John: Newton Plt of Accamak Somerset County Ss. Hannah: Maynard ye Admrx of James Maynard Hannah: Maynard. Dfendt } deceased was attached to answer unto John: Newton in a plea of debt — ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ and whereupon the Sd John:Newton by Edward Jones his Attorney – Comes and Sayes that the Said James:Maynard upon the Second day of May in the year of or Lord 1693// then became indebted unto the Said John Newton in the Sum & quantity of twelve hundred pounds of tobacco as appear by a Certain Writeing under the hand & Seal Said James Maynard & here in Court produced, which Said Sum of 1200 pounds of tobacco the Said James hath not payed in his lifetime nor Hannah the Admrx of the Said James hath not payed Since his decease, but doth refuse to pay ye afore Sum of 1200 pounds of tobacco although often thereunto required whereupon the plt Saith he is damnified and hath losse to the value of 2000 pounds of tobacco & hereupon brings his Sute — pr Quer Edward Jones.
Know all men by these prsents that I James Maynard of the County of Somerset & Province of Maryland Innholder am bound & Stand justly indebted unto John Newton of Accamack ye just Sum & quantity of twelve hundred pounds of good Sound Mertable tobacco & Caske for the true prformance whereof. I bind me my Heirs Extors & Admrs to pay or Cause to be paid the aforesd quantity of like tob. unto ye aforesd John: Newton him his Heirs Extors Admrs or Assigns at or upon the tenth day of October next ensueing the date hereof at Snow hill Landing or at Some Convenient Landing upon Pocomoke River it being for a valuable Consideration in hand allready recd In Witness whereof I have hereunto Sett my hand & Seal this Second day of May 1693. // James: Maynard ❂ Sealed – Signed Sealed & delivered in prsence of us // Stephen: Page. Robt: Pirrie After the foresd Decl & Bill being read. mr Edward Jones Made Oath in Open Court that mr Matt: Scarbrough. promised to Satisfie & pay the foresd Bill of 1200lb of tob And thereupon mr Peter Dent Attorney for the sd Maynard Confest judgmt when assetts which being Considered this Court grants Order thereon with Cost alias Executio //
John: Cole: Plt Somerset County Ss / Thomas Delahide & Anne his Wife Admrx of all & Singular ye goods Chatells Tho: Delahide Dft } & Credits of Alexander Addison deceased was Sumoned to answer unto John:Cole of Accamack ~ ~ ~ ~ ~ ~ ~ of a plea that they render unto him the full & just Sum of four hundred & Sixty pounds of of Merchantable leaf tobacco & Caske: - - - - And whereupon the sd John. by Peter Dent his Attorney Complains that whereas the sd Alexander in his lifetime (viz) ye 28th day of May in the yeara of our Lord 1684 at Monocan within the Jurisdiction of this Court by his Certain Bill Obligatory which the said John with the Seal of ye sd Alexander Signed bringeth here into Court the date whereof is the day & year aforesd acknowledge himself to be indebted in his life time to the sd John: Cole in the sd full & just Sum of four hundred & Sixty pounds of tobacco to be paid to ye Said John: Convenient in Accamack County on ye Bay Side at or upon ye 10th :day of October next ensueing ye date of ye Said Bill, to which payment the Said Alexander bound himself firmly by the Said Bill Nevertheless the sd Alex in his life time nor ye sd Perthema Since ye death of the Said Alex. to whome Admrn of the goods Chattels & Credits of ye sd Alexander was Comitted hath not paid while She was Sole & unmarried nor The Said Thomas & Anne Since the marriage – between them had & Solemnized nor any of them the Same to the Said John. hath not Paid but hath hitherto
