Thomas: Ball Plt            Somerset County Ss // John:Poplewell of this County Planter was attached to answer

Jno: Poplewell Dft }    unto Thomas: Ball of the Same County of a plea of Trespas upon the Case —

~ ~ ~ ~ ~ ~ ~     And whereupon the Said Thomas by Peter Dent his Attorney Complaineth that

                                           whereas the Said John. ye 15th.June 1693 at Monokin within the Jurisdiction of

This Court was indebted to the Said Thomas in the Sum of 450 pounds of tobacco for goods & Merchandizes by the

Said Thomas Sold & delivered to the Said John and the Said John. to the Said Thomas in manner aforesd being

Indebted did assume upon himself & faithfully promise that he the sd John the Sd Sum of 450 pounds of tobacco

to the Said Thomas would well & truely Content & pay. Nevertheless the sd John his promise & assumption aforesd

not regarding but minding & fraudulently intending him the Said Thomas in this behalf to deceive & defraud

the Sd Sum of 450 pounds of tobacco or any part thereof the Same to the Sd Thomas hath not paid although --

often demanded but hath hitherto refused & doth Still refuse to the damage of the Said Thomas of 900 pounds of

Tobacco and thereof he brings his Sute &ca. Pleg                    Jno. Doe

Ordered by the Justices in Court Sitting that the Overseers of their Severall & respective hundreds within the County abovesd

doe keep & maintain their Maties high wayes well Cleared & grubbed as well above as below twenty foot Wide as they

will answer the penalty of the Law which Sd Worke is to begin at or upon the 10th day of October next after ye date hereof.



Ordered that mr Ephraim: Wilson employ Some prson to amend the Bridge at the head of Monnokin River, and that the sd

Wilson or undertaker to be allowed for the Same.

                                                                                                          Court adjourned till tomorrow at 8 a Clock

~ ~ ~ ~ ~ ~ ~      the Case. // And whereupon the Said John & Neal by Samuel:Worthington their

Attorney Complaineth that whereas the Said John on the 27th. day of November ano Domini 1693// at Monokin

within the Jurisdiction of this Court became indebted unto the Said John. & Neall in the just Sum of thirteen hundred

pounds of good Merchantable tobacco it being for the building of a Boat for him the sd John:Strawbridge now the

Said John being indebted in manner & form aforesd, did faithfully promise & upon himSelf assume that the afsd

Sum of tobacco to the Said John & Neal he would well & truely Content & pay when thereunto required. Nevertheless
