( 133 ) The Said John the Said Sum of tobacco to the sd John & Neall hath not paid, but hitherto doth refuse to pay to the great loss & damage of the sd John & Neal of 2600 pounds of like tobacco & therupon they bring this Sute, &ca. Worthington pr Qr. pledge &ca {Jno Doe Rich:Roe} Loving friend mr Robert Catlin Novembr. ye 27th. 1693 // I pray yw pay unto John:Poore & Neal Macay thirteen hundred pounds of tobacco & take their discharge for ye Same it being the whole for the building of a Boat for me make good payment, which shall oblige me & my Heirs to make yu the like paymt againe, and to allow you the Same in the rent which yw owe me, for the Plantations which Bryan: Conovey decd held from me. being all at present from. // your very Loving friend John: Strawbridge .
The Defendants Attorney mr Dent in Open Court Confest judgmt for the debt declared for. And this Court grants order for the Same with Cost of Sute alias Executio. //
John: Tayler Plt. Maryland / Somerset County Ss //John:Strawbridge of this County was attached to answer Jno:Strawbridge Dft } unto John: Taylor in an accon of the Case. &ca. — And whereupon the plt by Edward ~ ~ ~ ~ ~ ~ Jones his Attorney Comes & Sayes that in the year One thousand Six hundred eighty Seven, That the Said John: Strawbridge did make a bargaine with the Said Taylor for a piece of Land but when time of payment Came was not able to comply with what he did assume, but had paid the Sum of five hundred pounds of tobacco unto mr Andrew Whittington for my Owne use also had given the plt Credit in Joseph Thaxter Store for One hundred & fourty pounds of tobacco for fees being due to the sd Taylor in all amounting to 640 lbs of tobacco, which Same the Sd John Taylor did give the Dfendt an Recept for & mentioning for what paid in the Recept but the Said Dft not having the fear of God before his eyes & being moved by the instigation of the devil & his imasories hath Sued the plt & recovered an Order agt the Said Taylor for the Sum of 280 Pounds of tobacco Cost & all whereupon the plt Saith that he is damnified to the value of 3000 lbs of the like tobacco & thereupon brings his Sute. &ca. pr Qr Edward: Jones
And the Dft by Sam: Worthington his Attorney Comes & Saith that the plt his action he ought not to have by by reason he hath not laid his accon within the Jurisdiction of this of this Court nor hath not declared for any debt. nor hath not put in any pledges to prosecute, & Sath that ye accon he ought not to have & puts him Self upon the Court. Worthington. //
No Reply being made to the foresd Plea a Non Sute was granted agt the plt wth Cost alias Executio
Thomas: Poole Plt Somerset Ss // Gregory Murmurenough of Somerset County Planter was attached to answer Gre:Murmurenough Dft} unto Thomas: Poole of the Same County Planter of an accon of the Case &ca. - - - - - ~ ~ ~ ~ ~ ~ ~ ~ And whereupon the Said Thomas by Sam Worthington his Attorney Complains that whereas The Said Gregory on or about the 27th-day of May in the year of our Lord 1694. at Back Creek wthin ye Jurisdiction of this Creek Court. Did wilfully Spitefully & malitiously with a gun did Shoot & wound in the flank with Shott one black Stone horse of the value of eight hundred pounds of tobacco being the propper goods of him the aforesd Thomas of which wounds the aforesd horse did dye. for which the Sd Thomas Saith he is damnified to the value of 1600 pounds of tobacco and thereof he brings this Sute &ca. Verte //
