( 147 ) And whereupon the Said John and Charles by Sam: Worthington their Attorney Comes & Saith that at Monocan within ye Jurisdiction of this Court that on or about the 1st day of May in the year of or Lord God 1682. The Said Robert became indebted unto the aforesd John & Charles in ye just Sum of Twenty four pounds Sterling for One Bill of Exchange made payable to Lieut Coll Claybourne or order is the aforesd John & Charles as by ye [Prolest] of the sd Bill appears under the hand of the Notary Publick which Said Bill of Twenty four pounds Sterling money of England with damages & profest amounts to the just Sum of twenty Seven pound fourteen Shillings & Six pence which is the Right of them the foresd John & Charles & for want of ye payment of the Said Sum the Said John & Charles Say they are damnified & have recd damage to the value of fifty five pounds nine Shillings of like money & here upon they bring this Sute &ca. {Jno Doe Worthington pr Quer Plegs &ca. The Decl: being read the Defendts Attorney Craved Oyer of ye Bill wch to him ws granted. The plts Attorney Craved Special Bail but the Court opinion was that sd Bail could not be required therein. To all Christian People to whome these presents Shall Come Know you that I Andrew Whittington of Monokin in the County of Somerset & Province of Maryland for Several Causes & Serious Considerations me here unto moving as also the Natural love and affection that I bear & have unto my daughter Ursula Whttington having given granted and doe by these presents freely voluntary & absolutely give and grant all and Singular that parcell and Tract of Land Knowne and Called by ye Name of Webly Containing & laid out for two hundred & fifty Acres being the Plantation that I now live upon, also ninety Acres of land known & Called by ye Name of Chance with all and Singular the Rights profitts privi- =ledges & benefits there unto belonging, with houses Orchards or gardens & inclosures to her ye sd Ursula Whittington & to the Heirs of her the Said Ursula Whittington for ever To have and to hold the Said Two Tracts of Land Called as aforesd freely Clearly & absolutely from me the aforesd Andrew Whittington my Heirs Extors & Admrs for ever without any Claime title or interest that I the Said Andrew or my aforesds Can or may have hereafter to the sd Two Tracts of Land Given & granted to her the sd Ursula aforesaid Deed & State in the sd Two Tracts of Land by delivery of one Twiste or Twigg in behalfe of the whole as by ye Said Deed of Guift is intended meaned in Witness whereof I have here unto Sett my hand & fixed my Seal this Sixth day of November 1694.
