FROSTBURG

Allegany County
Annexation Resolution

A Resolution of the Mayor and City Council of Frostburg, to en-
large the corporate boundaries of the City of Frostburg, and thereby
amend the Charter of the City of Frostburg.

WHEREAS, the Mayor and City Council of Frostburg, pursuant to
the authority contained in Article XI-E of the Constitution of the State
of Maryland, and Article 23A, Section 19, of the Annotated Code of Mary-
land (1957 Edition, as amended), deem it in the public interest to enlarge
the corporate boundaries of the City of Frostburg, and

WHEREAS, the area to be annexed is contiguous and adjacent to the
existing corporate area, and consent for said annexation has been ob-
tained from the owner of all the real property located in said area to be
annexed, and there being no persons residing in the said area.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND
CITY COUNCIL OF FROSTBURG, pursuant to the above mentioned
authority, that the present corporate limits of the City of Frostburg, as
described in Section 169 of the Code of Public Local Laws of Allegany Coun-
ty (Everstine's 1963 Edition), and in Section 2 of Chapter 662 of the
1953 Acts of the General Assembly of Maryland, be enlarged to include
the following area:

BEGINNING at a point on the existing corporate line, said point
being at the end of 52.42 feet on the third line of a parcel conveyed by
the Consolidation Coal Company to the Board of Education of Allegany
County, Maryland by deed dated December 1, 1938, duly recorded among the
land records of Allegany County, Maryland; thence leaving said third line
of the school lot and with the southwesterly margin of the right-of-way
of relocated Route 36 for the next five courses and distances, South 62
degrees 41 minutes 57 seconds East 155.12 feet to a stake; thence with a
curve to the right subtended by a chord bearing South 59 degrees 27
minutes 02 seconds East 130.35 feet to a stake; thence South 40 degrees
42 minutes 02 seconds East 144.95 feet to a stake; thence South 08 degrees
55 minutes 02 seconds East 114.26 feet to a stake; thence with a curve to
the right subtended by a chord bearing South 41 degrees 18 minutes 41
seconds East 124.16 feet to a stake; thence leaving said right-of-way,
South 48 degrees 41 minutes 19 seconds West 40.00 feet to a stake; thence
South 26 degrees 45 minutes 00 seconds West 599.47 feet to a stake; thence
North 63 degrees 15 minutes 00 seconds West 588.59 feet to a stake at
the end of 895.06 feet on the third line of the aforementioned school lot;
thence continuing with part of said third line of school lot, North 26 de-
grees 45 minutes 00 seconds East 842.64 feet to the beginning, containing
10.65 acres, more or less.

AND BE IT FURTHER RESOLVED, That the provisions of the
Constitution and Laws of the State of Maryland applicable to the City of
Frostburg which are now in effect, or which may hereafter be enacted, and
the Charter and all existing Ordinances of the City of Frostburg which
are now in force, shall be and the same are hereby extended and made
applicable to the residents and property in this annexed area.

AND BE IT FURTHER RESOLVED, That the Mayor of the City of
Frostburg shall cause a public notice of the introduction of this Resolu-
