CHARTER AMENDMENT RESOLUTION NO.
RESOLUTION of the Council of the Mayor and City Council of Ocean City
adopted pursuant to the authority of Article 11E of the Constitution of Maryland
and Section 13 of Article 23 A of the Annotated Code of
Maryland (1966 Replacement Volume), title "Corporations -
Municipal," sub-title "Home Rule," to amend the Charter of the Mayor and City
Council of Ocean City, as set forth in Sections 170 to 208K, inclusive, of the Code
of Public Local Laws of Worcester County (1961 Edition and 1968 Supplement,
being Article 24 of the Code of Public Local Laws of Maryland), as amended, by
repealing Section 197D thereof pertaining to the exercise of powers relating to
water and sewers in order to eliminate such inapplicable provisions from said
Charter, and to renumber as Section 197D existing Section 197E adopted April 25,
1967 (effective June 14, 1967).
Section 1. BE IT RESOLVED by the Council of the Mayor and City Council
of Ocean City that the Charter of said municipal corporation as set forth in
Sections 170 to 208K, inclusive, of the Code of Public Local Laws of Worcester
County (1961 Edition and 1968 Supplement, being Article 24 of the Code of Public
Local Laws of Maryland), as amended, be and the same is hereby amended by
repealing Section 197D thereof, and by repealing and reenacting with amendments
Section 197E thereof, as follows:
[197D. EXCEPTION.
The provisions of this charter pertaining to water or sewer shall not extend to
any town located in a sanitary district or special tax area or district authorized to
discharge the powers provided in this charter, as to the particular powers included
in the authorization, unless requested to do so by said town at a mutually agreed
upon rate.]
197[E]D. (a) Nothing contained in this charter shall be construed as affecting
or prohibiting in any manner the exercise within the corporate limits of Ocean City
of any and all powers conferred by law upon the County Commissioners of
Worcester County, the Worcester County Sanitary District (organized and existing
pursuant to the provisions of Sections 645 to 673, inclusive, of the Annotated Code
of Maryland [1965 Replacement Volume], as amended from time to time), or
other special tax area or district, in connection with water and sewerage facilities,
and consent to the exercise of such powers is hereby expressly granted. The
provisions of this Section shall be self-executing, and no further consent shall be
required on behalf of the town in connection therewith. Nevertheless, all water
systems and sewerage systems constructed and operated within the corporate limits
of Ocean City shall be designed and planned to avoid duplication in the rendition
of public services, whether such services are provided by the town or another entity
