2384                                    MUNICIPAL CHARTERS

notice to the Secretary of State of Maryland and to the State Department of
Legislative Reference, that the Charter of the Town of Ocean City, Maryland, has
been amended as follows:

1.  Section Amended - SECTION 202 B - "OATH OF OFFICE" Complete text
of resolution amending said section of said charter is attached hereto. The date of
resolution is 21 February 1972.

2.  Referendum Election - There was no Referendum Election nor was there any
Petition for Referendum filed.

3.  Effective Date - Said amendment became effective 50 days after the date of
resolution, said effective date therefore being 12 April 1972.

4.   Votes Cast - The amendment was by way of legislative enactment by a
unanimous vote of 7 Councilmen for and none against and was thereupon
approved by the Mayor, Harry W. Kelley.

RESOLUTION OF THE MAYOR AND CITY COUNCIL

OF OCEAN CITY, MARYLAND
TO AMEND THE TOWN CHARTER

Resolution of the Mayor and City Council of Ocean City, Maryland adopted
pursuant to the authority of Sections 13 through 18 of Article 23A, Annotated
Code of Maryland, 1966 Replacement Volume, to amend Sub-Section (b) of
Section 202. "OATH OF OFFICE" of the Municipal Charter of the Town of Ocean
City, Maryland by eliminating from said sub-section and section of said charter the
matter hereinafter enclosed in double parentheses, and by adding to said sub-section
and section of said charter new matter hereinafter underscored as follows:

"202 OATH OF OFFICE.

(b) Before whom taken and subscribed. - [The Mayor and all members of the
Council shall take and subscribe this oath or affirmation before a duly appointed
Justice of the Peace or Trial Magistrate in Worcester County.] THE MAYOR
AND ALL MEMBERS OF THE COUNCIL SHALL TAKE AND
SUBSCRIBE TO THIS OATH OR AFFIRMATION BEFORE THE CLERK
OF THE CIRCUIT COURT FOR THE COUNTY OR BEFORE ONE OF
THE SWORN DEPUTIES OF THE CLERK. ALL OTHER PERSONS
TAKING AND SUBSCRIBING THE OATH SHALL DO SO BEFORE THE
MAYOR."

The Sub-Section (b) of Section 202 as amended shall read as follows:
202 OATH OF OFFICE.

(b) Before whom taken and subscribed. - The Mayor and all members of the
Council shall take and subscribe to this oath or affirmation before the clerk of the
circuit court for the county or before one of the sworn deputies of the clerk. All
