2398                                    MUNICIPAL CHARTERS

"Sec. 31-23. Construction of water supply and sewerage system.

"(d) The Commissioners of Rising Sun are further authorized and empowered
to borrow on its faith and credit from any banking institution within the State of
Maryland, a sum or sums of money not to exceed [$180,000.00] $500,000.00
dollars [at an interest rate not in excess of 5%], to be used for the construction
and establishment, extension, alteration, improvement and modification of the
existing sewerage system or existing water supply system, or both, and to evidence
such indebtedness by the issuance of its promissory notes, bonds, or other evidence
of indebtedness, whichever in the judgment of the said Commissioners of Rising
Sun shall best suit their interests and whichever may be acceptable by the banking
institution or institutions from which said sum or sums of money may be
borrowed, provided no notes or bonds shall be issued as evidence of such
indebtedness which shall mature later than 30 years from their respective date of
issue."

Resolution No. 5-72

RESOLUTION: To Provide for the Enlarging of the Corporate Boundaries of the
City of Rockville to Include 174.8176 acres, Contee Sand & Gravel Co., Inc.
(Gudelsky) Property

WHEREAS, heretofore a Petition has been presented to the Mayor and
Council of Rockville, proposing to enlarge the corporate boundaries of the City of
Rockville so as to include a tract of land known as the Contee Sand & Gravel
Co., Inc. (Gudelsky) property, formerly known as the Scott Farm, containing
174.8176 acres of land, more or less, located west of Great Falls Road, south of
proposed Ritchie Parkway, and generally west and south of existing corporate
boundaries; and thereafter upon verification of the requirements of subsection (c)
of Article 23A of the Annotated Code of Maryland, 1957 Edition, as amended,
had been complied with, a resolution was introduced proposing to change the
boundaries as requested in the Petition; and

WHEREAS, thereafter a public notice of said Resolution was published not
fewer than four times at not less than weekly intervals in the Montgomery County
Sentinel, a newspaper of general circulation in the City of Rockville and the area
to be annexed, the said notice specifying that a public hearing would be held on
said Resolution in the office of the Mayor and Council at 9:00 P.M. on the 18th
day of May, 1971; and

WHEREAS, the Mayor and Council of Rockville has fully considered and
deliberated the matters presented at said public hearing and has determined that
said Resolution should be adopted;

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND
COUNCIL OF ROCKVILLE, MARYLAND, That the following Resolution
adding a new section to the Charter of the City of Rockville, said new section to
be known as Section 82, Article I (to follow immediately after Section 81, Article
I thereof) and as Section 49-31yy, Montgomery County Code, 1960, (to follow
immediately after Section 49-31xx thereof) to provide for the enlarging of the
