AN ACT concerning

Geriatric Evaluation Services

FOR the purpose of [[establishing geriatric evaluation
service for elderly persons who are under
consideration for admission to certain related
institutions; and generally relating to the
voluntary and involuntary admission of elderly
persons to mental institutions.]] requiring that
elderly persons receive recommendations from
geriatric evaluation units as a condition of
admission to mental institutions.

BY repealing and reenacting, with amendments,

Article 59 — Mental Hygiene

Section 11(b)

Annotated Code of Maryland

(1972 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 11(b) of Article 59 - Mental
Hygiene, of the Annotated Code of Maryland (1972
Replacement Volume and 1975 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows:

Article 59 — Mental Hygiene

11.

(b) (1) [No] A person [shall] MAY NOT be
admitted under the provisions of this section unless his
condition is such that he is able to understand the
nature of his request for admission, is able to request
his release, and is capable of giving continuous assent
to his retention by the facility.

(2) [[PERSONS]] ON OR AFTER__JULY 1, 1977,

PERSONS 65 YEARS OF AGE AND OLDER MAY BE INVOLUNTARILY OR
VOLUNTARILY ADMITTED TO A FACILITY ONLY IF THEIR
ADMISSION IS RECOMMENDED BY A GERIATRIC EVALUATION UNIT
[[ESTABLISHED BY SECTION 59 OF THIS ARTICLE]].

[[SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 6 to be under the new subtitle "Geriatric
Evaluation Services" be and it is hereby added to Article
