THE PRESENCE OF THE STATEMENT REQUIRED BY SUBSECTION (B) OF
THIS SECTION ON AN INSTRUMENT OF WRITING IS PRIMA FACIE EVIDENCE
OF PAYMENT OF TRANSFER TAX.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 81, §
278A(e) and the second clause of (b)(1).

In subsection (a) of this section, the reference to
the tax being payable "where the instrument of writing
is recorded" is added for clarity.

Also in subsection (a) of this section, the reference
to the transfer tax being "paid to" the clerk and the
Department is substituted for the former reference to
"shall be collected", for clarity.

In the introductory language of subsection (b) of this
section, the reference that an instrument of writing
"may not be recorded" is substituted for the former
reference to "[p]ayment of the tax ... shall be
evidenced", for clarity.

Also in the introductory language of subsection (b) of
this section, the word "statement" is substituted for
the former word "legend", for clarity.

13-209. DISTRIBUTION OF REVENUE.

(A)  SPECIAL FUND.

THE REVENUE FROM TRANSFER TAX IS PAYABLE TO THE COMPTROLLER
FOR DEPOSIT IN A SPECIAL FUND.

(B)  PURPOSES OF FUND.

(1) THE SPECIAL FUND UNDER SUBSECTION (A) OF THIS
SECTION:

(I)  IS USED TO PAY PRINCIPAL AND INTEREST ON
THE BONDS ISSUED UNDER THE OUTDOOR RECREATION LAND LOAN OF 1969;
AND

(II)  SUBJECT TO PARAGRAPH (2) OF THIS
SUBSECTION, THE BALANCE OF THE REVENUE, NOT REQUIRED UNDER
PARAGRAPH (1)(I) OF THIS SUBSECTION, SHALL BE ALLOCATED:

1. $24,000,000 AS PROVIDED IN THE STATE
BUDGET FOR THE PURPOSES SPECIFIED IN TITLE 5, SUBTITLE 9 (PROGRAM
