EXECUTIVE ORDER OF SEPTEMBER 7, 1979

DECLARATION OF EMERGENCY
UNIVERSITY OF MARYLAND PHARMACY SCHOOL
CAPITAL PROJECT
WHEREAS, The General Assembly of Maryland, recognizing the
need for a School of Pharmacy of the University of
Maryland, has appropriated funds for the construction
of a School of Pharmacy; and
WHEREAS, The project has been delayed approximately two
years due to fundamental differences in concepts by
architectural review boards; and
WHEREAS, The delay resulted in a substantial increase in
the estimated cost of the project; and
WHEREAS, The increase required an architectural and
engineering reexamination of the entire project by an
architect and a value engineer in an effort to complete
this project within the limits of the funds
appropriated; and
WHEREAS, The architectural firm which was the prime design
consultant for the project has filed for protection
under the bankruptcy laws of the United States, thereby
necessitating the securing of the services of a
substitute or successor architectural firm; and
WHEREAS, I am advised that a conservative estimate of the
effect of inflation on this project is at least 1 1/2%
or approximately $150,000 per month, and, further, that
the securing of a substitute or successor architectural
firm through full compliance with the selection
requirements set forth in Section 231V(a) of Article 41
of the Annotated Code of Maryland will involve a delay
of at least approximately four months and thereby not
only delay the completion of the project but
substantially increase the cost thereof; and
WHEREAS, I am advised that, in order to avoid significant
unnecessary delay and expense, it is essential that the
University of Maryland be free to retain the services
of a joint venture consisting of the
mechanical/electrical engineer and the structural
engineer which were involved in the original design and
the architectural firm which functioned as the value
engineer in the reexamination of the project; and
WHEREAS, Upon the request of the Chancellor of the
